Misdemeanors Qualify for Okmulgee Criminal Records Expungement
Some Oklahoma misdemeanors can be expunged immediately. If you were convicted of a misdemeanor for which you served no jail time and the fine was less than $501, you can file a Petition for Expungement immediately.
If you have completed a deferred judgment or suspended sentence on a misdemeanor charge, and you have never been convicted of a felony, the waiting time is one year.
You must wait five years after completing a sentence on a misdemeanor conviction that resulted in jail time or a fine in excess of $500, if you have never been convicted of a felony. Okla. Stat. tit. 22 § 18
Felonies Also Qualify, But the Wait is Longer
New legislation has shortened the waiting time for eligibility from 10 years to 5 years after the completion of a deferred judgment or delayed sentence on a non-violent felony charge. While five years seems like a long time, the new legislation makes it possible to put your past behind you so much sooner.
Likewise, if you have been convicted of a non-violent felony and received a full pardon, not been convicted of any other felony, and not been convicted of a misdemeanor in the past 15 years, you may file for expungement of your Okmulgee criminal records 10 years after your felony conviction.
If you have been convicted of no more than two non-violent felonies, have received a full pardon, and have no other charges pending against you, you may file for expungement once at least 20 years have passed since your last misdemeanor or felony conviction.
