The Oklahoma petit larceny statute is broadly written. As such, there are many situations that the statute could cover. Just about any time a person takes something that doesn’t belong to them and the value is $1,000 or less, it will be considered petit larceny. While the differences between grand larceny and petit larceny may seem small, there are big differences in the penalties for each.
Potential Penalties
Violating Oklahoma petit larceny laws is punishable by a fine of from $10 to $500 and a jail term of not more than six months. Okla. Stat. tit. 21 § 1706.
In comparison, grand larceny is a felony crime punishable by imprisonment in the State Penitentiary for up to five years if the value of the property taken is $1,000 or more.
If the value of the property is less than $1,000, it is punishable by incarceration in the county jail for up to six months. They may also spend one or more nights or weekends, at the discretion of the court, and a fine of up to $500.
In addition, if convicted of any larceny offense, you may have to pay restitution to the victim. Okla. Stat. tit. 21 § 1705
