Understanding Probation: Deferred vs. Suspended Sentences
This is Jay Bills, the Okmulgee attorney. I’m here with the Wirth Law Office and today I want to talk to you about probation and what that can mean for you in regards to a criminal charge that you’re looking at. You know there’s a suspended sentence, there’s a deferred sentence, and how does that affect you moving forward with your life.
Deferred Sentence Explained
With the deferred sentence, the judge is going to hold a finding of guilt until after that probation is over. When that probation is over, the judge is going to be able to, you’ll be eligible for an expungement. So it’ll be like that’s never been on your record, you were never charged with that crime at all.
Suspended Sentence Explained
With a suspended sentence, you’re going to plead guilty in the beginning and at the end of probation you’re still going to be guilty, it’s going to be on your record. So you certainly want an attorney who’s going to be able to try to fight for you and get that deferred sentence up front and then hopefully we can get that expungement from your record moving forward so it doesn’t impact you with jobs or custody or anything like that with your kids.
